3 Anarchist Victims of Spanish Repression freed : There’s no Evidence

Freedom is the crimeThe National Court has ordered the release without bail bond  for three of the five people who were until now in custody, detained under the ‘Operation Piñata’, anti anarchist raids, on 31 March.

As  explained  Daniel Amelang to the paper Diagonal, one of the lawyers representing the defendants in Operation Piñata, they are now waiting for the Court to rule on the freedom of the other two people who are still in custody.piñata victory

“The Court has held that the detention was disproportionate,” explains Amelang. “So far maintained the charges against them, but they have seen that it is unnecessary are now in prison,” he concludes. It is expected that at least three people to whom the Court has confirmed the release without bail out along this afternoon of the various prisons to which they were scattered on May 18.

In all three cases for which the release is ordered, the Third Section of the Criminal Division of the National Court notes that the decision of the judge of the Audiencia Nacional Eloy Velasco  ( the High Court controlled by the neo fascist Right) did not provide “sufficient” evidence or realization of alleged terrorist activities allegedly committed by detainees when he ordered their entry into custody.

All the arrested in the Pandpra and Piñata raids were related to two anarchists awaiting trial for allegedly bombing a church!  The Spainish right are still furious about this as it referred to the mega crimes of the church in aiding the fascist dictatorship, many of the arrested anarchists were accused of being in a prisoners support group for the two, Fransico and Monica. The campaign for their release continues with hope after the Piñata raids seem to be falling apart.
All the arrested in the Pandora and Piñata raids were related to two anarchists awaiting trial for allegedly bombing a church! The ruling Spanish right , highly infiltrated by Opus Dei, are still furious about this little bomb which hurt nobody as the claim referred to the mega crimes of the church in aiding the fascist dictatorship (eg handing thousands of anarchists to the State death squads). Many of the arrested anarchists were accused of being in a prisoners support group for the two, Fransicso and Monica. The campaign for their release continues with hope after the Piñata raids seem to be falling apart.

He also cites an action of defense of one of the detainees in which it noted that the link between GAC [Anarchist Groups Coordinated] and terrorism was “absolutely arbitrary.”SOLI

Operation Piñata took place on March 30 and led to the sacking of several occupied anarchist social centers in Madrid and the arrest of 28 people, fifteen of them accused of being part of an anarchist terrorist organization and other offenses of disobedience, resistance or encroachment .

The operation was ordered by the judge of the Audiencia Nacional Eloy Velasco, who claims that the detainees would be part of an alleged terrorist  platform called Coordinated Anarchist Groups (GAC) that would be related to an international group called FAI / FRI.

The operation was a continuation of Operation Pandora, ordered by Judge Javier Gomez Bermudez of the National Court which took place mainly in Barcelona on 16 December. In its framework they were arrested eleven people. Seven of them were sent to custody until January 30 Bermúdez decided their release on bail of 3,000 euros.images

The same day that the High Court has ordered the release without bail for three of the detainees Piñata operation, the judge of the Audiencia Nacional Eloy Velasco, isntructor of this case, has  ordered the blockade and seizure of bank accounts opened days after the Pandora operation after December 16 [predecessor of the Piñata series of raids], in which 11 people were arrested, seven of whom were remanded in custody until 30 January.pandoraterroristaeselestado

As explained in the blog Efecto Pandora, an order signed by Velasco asked the Information Brigade of the National Police to blockade and embargo  these solidarity accounts and also investigate bank transactions made since their opening.

Hopes are high that the last two of these ‘hostages of State terror’ will also go free, as their cases seem identical.terroristas

 La Audiencia Nacional ha ordenado la puesta en libertad sin fianza para tres de las cinco personas que seguían hasta ahora en prisión provisional, detenidas en el marco de la Operación Piñata, el pasado 31 de marzo. Según ha explicado a Diagonal Daniel Amelang, uno de los abogados que representan a los acusados de la Operación Piñata, están ahora a la espera de que la Audiencia se pronuncie sobre la libertad de las otras dos personas que aún siguen en prisión preventiva.

“La Audiencia ha considerado que la prisión preventiva era una medida desproporcionada”, explica Amelang. “De momento mantienen los cargos contra ellos, pero han visto que es innecesario que estén ahora en prisión”, concluye. Se espera que al menos estas tres personas a las que la Audiencia ha confirmado la libertad sin fianza salgan a lo largo de esta tarde de los distintos centros penitenciarios a los que fueron dispersadas el 18 de mayo.En los tres autos por los que se ordena la puesta en libertad, la Sección Tercera de la Sala de lo Penal de la Audiencia Nacional señala que la resolución del juez de la Audiencia Nacional Eloy Velasco no aportaba indicios suficientes ni concreción “suficiente” de las supuestas actividades terroristas que habrían cometido los detenidos como para ordenar su entrada en prisión preventiva. También cita un recurso de la defensa de uno de los detenidos en los que se señalaba que la vinculación entre las GAC [Grupos Anarquistas Coordinados] y el terrorismo era “absolutamente gratuita”.

La Operación Piñata tuvo lugar el 30 de marzo y supuso el registro de varios centros sociales ocupados en Madrid y la detención de 28 personas, quince de ellas acusadas de formar parte de una organización terrorista anarquista y el resto por delitos de desobediencia, resistencia o usurpación. La operación fue ordenada por el juez de la Audiencia Nacional Eloy Velasco, que afirma que los detenidos formarían parte de una supuesta plataforma terrorista llamada Grupos Anarquistas Coordinados (GAC) que estaría relacionada con un grupo internacional denominado FAI/FRI.

La operación fue la continuación de la Operación Pandora, ordenada por el juez de la Audiencia Nacional Javier Gómez Bermúdez y que tuvo lugar principalmente en Barcelona el 16 de diciembre. En su marco se detuvieron a once personas. Siete de ellas fueron mandadas a prisión preventiva hasta que el pasado 30 de enero Bermúdez decidió su puesta en libertad bajo fianza de 3.000 euros.

El mismo día en que la Audiencia Nacional ha ordenado la libertad sin fianza para tres de los detenidos de la operación Piñata, el juez de la Audiencia Nacional Eloy Velasco, isntructor de esta causa, ha ordenado el bloqueo y embargo de las cuentas bancarias abiertas días después de la operación Pandora del 16 de diciembre [antecesora de la Piñata], en la que fueron detenidas 11 personas, 7 de las cuáles estuvieron en prisión provisional hasta el 30 de enero.
